Beyond contempt

--> We are a site of 76 Freehold Homes and Blue Property are the owners of the Management Company responsible for Managing our Landscaping.--> Blue Property have been responsible for "managing" the Landscaping in the Common Parts pertaining to our Freehold Houses for over 5 years now.--> We have continuously made them fully aware of the defects with the site landscaping since they sent their first invoices in 2020, which they will be aware of beyond reasonable doubt.--> They have not been adhering to the legally binding Section 106 Landscaping Management Plans which are conditional to the planning permission of the site.--> They are implicated by Keepmoat in the TP1 to follow the Agreed Landscaping Plans stated in the S106 Agreement, and that no other landcaping condition is acceptable.--> As part of this agreement (16/03861/FU@Leeds), any failed planting within the Common Parts in the first 5 years is supposed to be replaced at Keepmoat's cost by The Management Company, within the next available planting season.--> Most of the 50+ trees in their care on our site are now dead, and / or were never alive since planting, and our annual bills have more than doubled in the last 5 years--> They say they're not paid to water the trees. But they are paid to keep the trees alive in the first 5 years, and if they die they need to replace them.--> When we complain Blueproperty say we should speak with Keepmoat to rectify this and that Blueproperty only have to maintain what was left by Keepmoat, and that Keepmoat won't work with them to rectify issues in the Common Parts, whereas our TP1 contract with Blueproperty (c/o The Management Company) and Keepmoat suggests otherwise.--> Per the TP1 and S106 Agreement, Keepmoat are liable to cover replacement of any failed Landscaping planting in the Common Parts within the first 5 years of site completion and you would have thought this would fall under Blueproperty's remit as Landscaping Managment Company to arrange this with them, as part of their normal duties, as the assets within the Common Parts which they are overcharging us to manage are covered per the conditional Planning Permission.--> This is just the latest incident where they clearly are not able to manage our site properly, and on that basis I would not recommend them at all and cannot believe that we are stuck with a company that is breaking Planning Law yet the Law still seems to protect the (in)actions of this shameful company over innocent homeowners who have been tricked into this scam by being told lies in the sales process by the housebuilder Keepmoat, and had concerns downplayed / ignored by both Blueproperty and Keepmoat ever since.
