Even though they are the ones who will receive your money, Kickstarter avoids accountability for fraudulent projects on their platform. Even though they write the contract, take your money, and make you agree to it when you back a project, their Terms of Use state they are not a party to the contract between backer and author. I'm not sure how legal this is, and it certainly isn't lawful under EU consumer law. They should not be permitted to trade with the European Union.
