They are deceptive because they have trained their staff to ask you for what drink you want, suggesting it comes with the meal. Instead, the question should be “Do you want to order a drink with that?” Rather than, “And your drink? Or what drink?” When I asked the manager about it she acknowledged they are supposed to ask that way. It has created embarrassment and confusion when people I was with didn’t realize it was a separate charge until after they got their receipt and then wanted to fix the charge, requiring a refund and wasted time while others were waiting.
