Luxury bouquet delivered incomplete – refusal to honour consumer rights
I received a “luxury bouquet of 51 roses”. On delivery, two of the stems had no flower heads attached, despite being cleanly cut to the correct height.
I contacted the company immediately, within their stated time limits, and provided clear photographs. Rather than arranging a replacement or refund, the company suggested the damage may have occurred during delivery and later argued that fresh flowers are exempt from full consumer protection because they are perishable.
They relied on the Consumer Contracts Regulations 2013 to refuse a full refund, despite the issue being a defect present at delivery and the order not matching its description. They also attempted to impose a pro-rata refund, which I did not accept.
This approach contradicts both the Consumer Rights Act 2015 and the company’s own published policy, which states that mistakes notified promptly with photos will be replaced at their cost.
The issue here is not a minor quality dispute, but how the company responds when a clear problem is raised. Based on my experience, I would advise caution when ordering high-value bouquets for special occasions.
