Response to Reply:
Thank you for the templated response. I was anticipating this standard reply, which unfortunately ignores the specific issues identified with the listing.
While you highlight the 'viewing period,' this was a 'Parcel Delivery Only' lot. Suggesting a buyer should travel to a site to inspect an item that your own terms prohibited them from collecting is a significant logical and logistical contradiction.
More importantly, your response fails to address the two primary failures:
Misdescription: The listing utilized images of a clean unit. The item delivered was heavily soiled with internal debris—a significant hygiene concern that was not disclosed.
Electrical Fault: The unit is non-functional, with no power. Standard industry practice and consumer law require items with known electrical defects to be clearly marked as 'Spares and Repairs' or 'Faulty.' Failing to do so while providing 'clean' imagery is a material misdescription and against the sale contract.
Original Review:
I won a Hoover H-Upright 300 from John Pye Auctions (Chesterfield). The auction images showed a clean unit, but what arrived was a health hazard. The vacuum was heavily soiled, filled with debris/dirt, and missing several essential accessories. Most importantly, the unit does not power on. It is electrically dead.
When I contacted customer service, they completely ignored the fact that the item was misdescribed and faulty. They hid behind "viewing periods" despite this being a "Delivery Only" lot where I had no physical way to inspect the item. To make matters worse, they threatened to restrict my account if I disputed the charge with my bank.
It is illegal under the Consumer Rights Act to misdescribe an item and sell non-functional electronics without stating they are for "spares/repairs." Avoid this auction house; they have no interest in consumer rights or basic hygiene standards.
