My father recently passed away, there was an ongoing section 42 abuse enquiry about the quality of care he was receiving when he died.MFG as the solicitors who my dad appointed as his Estate legal representation. They where made aware at the time of his about the on going case. Everything they do is done so slowly.The local council messed up the section 42 enquiry to point of losing all evidence and incorrectly closing the case down. and also incorrectly told the police they had no concerns. This they later greed was wrong and agreed to rectify with the police. However after a separate but connected case was completed by the police, the police told me they had no record of any information from the local council. when I request this information from the local council when, who and what the told the police they said I would need a letter of permission from the estate executor or legal personal representative. When I ask MFG for this permissions letter they refused. saying“The decision was made to avoid the risk of the estate becoming more embroiled in the issue leading to additional costs and potential delay to the estate. In addition there is no financial benefit to the estate in becoming so involved. I understand that you have been advised that the Executors duty is to protect the Estate.”Or more simply to get paid as fast as they can.As an police investigation is unlikely to stop distribution of the estate. They are putting there payday for the justice system.I was even told by them I had dodgy legal advice, saying they are not the people to give me a permission letter as it is not within the remit. Despite who is reasonable for issuing the permissions letter been on NHS England, central and local government legal websites, continue this line even after I provided the evidence proving it.They also implied it would not be in the best interest of my father or his wishes to disclose this information.
