Dying customer wants to return- no can do apparantly

We purchased a personal alarm for our 92 year old mother on the 11th October. She was diagnosed terminal on the 14th. The alarm arrived 16th. We were obviously quite distracted so didn't open the package until a few days later. Didn't open anything within just looked for info to return it.They have just told us they don't refund except for defective. The goods are untouched and resaleable. It's really not acceptable and so ACL will be contacted as the client didn't just 'change her mind' she is dying and has no use for it and the item is new, unpackaged and can be resold. Seems like this might be an unusual case but should have been looked slightly more compassionately
