Incorrect Item Received – Breach of Contract / Consumer Rights Act 2015Dear Wowcher Customer Services,On 21 July 2025, I placed an order through your website for a 9 x 6 garden shed, for which payment was made in full.Upon delivery, however, I received a 6 x 4 garden shed, which is a smaller and lower-value product than the one I ordered. This means the goods supplied are not as described, constituting a breach of contract under Sections 9 and 11 of the Consumer Rights Act 2015.Under this legislation, I am entitled to receive the goods as described in the contract, or—if that is not possible—to an appropriate refund or price reduction.As I have already incurred costs for the assembly of the product, I am not in a position to dismantle and return the shed. Accordingly, I request that you issue a refund for the difference in price between the product I ordered (9 x 6) and the cheaper product supplied (6 x 4).Please confirm how you intend to resolve this matter within 14 days of the date of this letter. If I do not receive a satisfactory response within that period, I will consider escalating the matter through Alternative Dispute Resolution (ADR) or by issuing a claim in the Small Claims Court for breach of contract and failure to comply with the Consumer Rights Act 2015.I also note that your previous responses have consisted of automated messages advising that I either dismantle the shed at my own cost or accept a nominal 10% refund. Neither option is acceptable, as they do not reflect my statutory rights or a fair resolution under consumer law.I therefore request that you address this matter promptly and in accordance with your legal obligations.
