Dear Gentlemen l am writing to inform the Commission of the latest update regarding my complaint against XM Global.
Despite my previous explanation that a formal marriage certificate is physically impossible to obtain due to the ongoing civil war and the destruction of our home village in Myanmar, XM Global continues to ignore all other high-level legal evidence.
I have already provided:
The Official Birth Certificate of my child (which legally proves my 13-year relationship with my wife).
Wedding photos from 2013.
Proof of 3 years of successful business with them using these same funds.
XM’s latest response simply states that they will only process my case if I provide the non-existent marriage certificate. This is a deliberate "Impossible Condition" used to permanently withhold my $1,636.67.
I humbly request the Commission to intervene and direct XM Global to accept the Birth Certificate as valid legal proof of our union, as it is recognized in any court of law. My family relies on these funds for my child's education and health insurance.
I am filing a formal complaint against XM.
Key Points of My Complaint:
4-Year History: I have used this account for 4 years, with a total net loss of nearly 300,000 THB. XM accepted all these deposits from my spouse's account without any warning while I was losing money.
Unfair Enforcement: XM only terminated my account and seized my $1,636.67 balance now that I have finally made a profit. This is a clear case of selective enforcement to avoid payouts.
Family Ties: The funds belong to my legal spouse, Mr. Wai Yan Kyaw. I do not use mobile banking. We are a family unit with a young daughter (Birth Certificate attached).
Financial Hardship: This money is our life savings, meant for my daughter's education and health insurance. We have already sold our land and motorcycle to survive.
Requested Action:
I demand the immediate release of my full balance of $1,636.67 USD. XM's actions are predatory and lack transparency.
Sincerely,,
I am filing a formal complaint against XM (FSC) for the unfair termination of my account #314649737 and the seizure of my funds totaling 1,636.67 USD.
Timeline of Events (March 2026):
March 12: I deposited 9000, 3000, 5000, and 2500 THB. I lost these trades. XM accepted these deposits from my spouse's bank account without any warning or issue.
March 20: I deposited 1800 and 6500 THB. After successful trading, my balance reached $1,636.67 USD.
Withdrawal Attempts: When I tried to withdraw, XM repeatedly rejected my requests.
Stalling Tactics: For several days, XM forced me to undergo exhaustive verification, including:
Full ID documents.
A video selfie with my ID.
Detailed bank information.
Proof of income and pay slips.
Final Outcome: Despite providing EVERY requested document, XM waited until I had a significant profit to terminate my account citing "Third-Party Involvement."
Legal and Ethical Grounds for Complaint:
Bad Faith Practices: XM only flagged the "Third-Party" issue when I made a profit. They were perfectly happy to accept the same funds when I was losing on March 12. This is predatory and discriminatory.
Exhaustive KYC Compliance: I have fully cooperated with every invasive request (video, income proof). To terminate the account after receiving all my private data is a breach of trust and privacy.
Family Unit Exception: The funding comes from my legal spouse, Mr. Wai Yan Kyaw. I have provided our daughter's birth certificate as proof. I do not use mobile banking myself, and we manage our finances as a single household.
Extreme Financial Hardship: We are migrant workers in Thailand. This money is critical for my daughter's tuition fees and health insurance. We have already sold our assets (motorcycle) and land in Myanmar to fund our survival.
Requested Action:
I demand . XM to release my full balance of 1,636.67 USD immediately. Retaining these funds after 4 years of consistent use of the same bank account is an act of financial theft.
I have attached all identity documents, transaction logs, and family proof for your review.
Sincerely,
Phyu Sin Win
