Deceptive practices and disregard for consumer rights I contacted this company a month ago regarding the non-receipt of my item. Their response indicated that my package was left outside my address for an unknown duration, which I never approved. I reside in a busy area of east London where the crime rate is concerning, and understandably, I could not find the parcel. After initially requesting a replacement, it took them a month to propose any solution. By that time, I no longer needed the item and asked for a refund. The company outright refused to issue a refund, stating they could only offer a replacement or store credit since the item is marked as delivered. However, the item was NOT delivered, and their refusal to refund me violates consumer law. The provided image clearly shows the item abandoned on the ground in a public pathway. To clarify, Section 29(2) of the Consumer Rights Act states that goods remain at the seller’s risk until they are in your physical possession or with someone you explicitly authorized to accept delivery. This means:
• Simply being marked as “delivered” does not equate to actual delivery.
• A photo of a parcel left outside is not valid proof of delivery unless I agreed to that designated location or person. Furthermore, According to Section 20 of the Consumer Rights Act 2015:
• If a contract is considered terminated (e.g., due to non-delivery), you are entitled to a refund of the amount paid for the goods. In summary, I am entitled to a refund. I will pursue legal action if this issue is not resolved within one working day.
